Presentation of the Canadian UAW Women’s Advisory Council to the Legislative Committee – Bill 59


The Canadian UAW’s brief concerning Bill 59 argues that upon dissolution of marriage, all assets acquired after the marriage must be divided equally. The Ontario Government’s proposed Bill 59 fails to require this arrangement since its does not include in its definition of common property assets accessed by one spouse, such as pension benefits, insurance, and tax-sheltered savings plans. Any commercial venture should also be included. The brief notes that every family member contributes when a breadwinner’s compensation is directed towards acquiring these assets. The brief also condemns Bill 59’s inclusion of “conduct” as a criterion for determining support.
