In September 1989, the Canadian Advisory Council on the Status of Women (CACSW)/Conseil consultatif canadien sur la situation de la femme (CCCSF) released the background paper “Women’s Reproductive Health, the Canadian Charter of Rights and Freedoms, and the Canada Health Act”. The research by law professor Sheilah Martin indicates there is a legal basis for women to initiate a challenge to the Canada Health Act (CHA) under the Canadian Charter Rights and Freedoms, on the grounds that the principles of the Act are not being applied in a way which respects women’s right to equal treatment under the law.
